SquareTrade Thailand Co., Ltd. ("SquareTrade", "we", "our" or "us") respects your privacy and is committed to protecting your Personal Data in accordance with the Personal Data Protection Act B.E. 2562 (2019) of Thailand ("PDPA").

This Privacy Policy explains how we collect, use, disclose and otherwise process your Personal Data when you contact us or use services that we administer, including claims, Refresh and Swap services.

Personal Data We Collect

We may collect and process Personal Data including:

1. Your name;

2. Email address;

3. Telephone number;

4. Residential, collection or delivery address;

5. Device information, including the IMEI or serial number of your device;

6. Membership or programme information;

7. Details relating to service requests, enquiries, complaints and communications with us;

8. Information relating to Refresh or Swap service requests, including device assessment, repair, replacement, collection and delivery information; and

9. Any other information you voluntarily provide to us in connection with the services we administer.

We do not collect your national identification card number, bank account details or payment information as part of the Refresh or Swap claims journey.

How We Collect Personal Data

We may collect Personal Data:

1. Directly from you when you contact us, submit an enquiry, complaint or service request, or otherwise communicate with us;

2. Through the claims journey, including by email, telephone, online form or other service channel;

3. From the programme provider, retailer, mobile network operator or other business partner through which you obtained your membership or service, where necessary to confirm your membership or eligibility; and

4. From our affiliated companies and service providers involved in administering a Refresh or Swap service request.

How We Use Personal Data

We may collect, use and disclose your Personal Data for the following purposes:

1. Verifying your membership or programme eligibility for services;

2. Assessing, processing and administering Refresh and Swap service requests;

3. Arranging device collection, delivery, assessment, repair, refurbishment or replacement;

4. Communicating with you regarding your enquiry, complaint or service request;

5. Providing customer service and support;

6. Detecting, preventing and investigating fraud, misuse or unlawful activity;

7. Managing and improving our claims administration, services and customer experience;

8. Complying with legal, regulatory and contractual obligations; and

9. Any other purpose permitted or required by applicable law.

Disclosure Of Personal Data

We may disclose your Personal Data where reasonably necessary for the purposes described in this Privacy Policy, including to:

1. The programme provider, retailer, mobile network operator or other business partner through which you obtained your membership or service, including to verify your membership, confirm eligibility, provide updates about your service request and support the administration of the programme;

2. SquareTrade and Allstate affiliated companies that support the delivery and administration of the Refresh and Swap services;

3. Third-party service providers who assist us with customer support, logistics, collection and delivery, repairs, device assessments, replacement devices, technology services, fraud prevention and administrative services;

4. Professional advisers, auditors and insurers;

5. Government authorities, regulators, courts, law enforcement agencies or other parties where required or permitted by law; and

6. Any person or organisation to whom disclosure is authorised or required by applicable law.

We do not sell your Personal Data.

Overseas Transfers

To administer the Refresh and Swap services, your Personal Data may be disclosed to or accessed by SquareTrade and Allstate affiliated companies and service providers located outside Thailand.

These countries may have privacy laws that differ from those in Thailand.

Where Personal Data is transferred outside Thailand, we will take reasonable steps to ensure that appropriate safeguards are implemented and that your Personal Data remains protected in accordance with applicable legal requirements.

Data Retention

We retain Personal Data only for as long as reasonably necessary to fulfil the purposes described in this Privacy Policy, comply with legal or regulatory obligations, resolve disputes and enforce our rights and agreements.

Once Personal Data is no longer required, it will be deleted, anonymised or securely destroyed in accordance with our retention requirements.

Security

We take reasonable technical, administrative and physical measures to protect Personal Data against loss, misuse, unauthorised access, alteration or disclosure.

While we take reasonable precautions to safeguard Personal Data, no system can be guaranteed to be completely secure.

Your Rights

Subject to applicable law, you may have the right to:

1. Request access to Personal Data relating to you;

2. Request correction of inaccurate or incomplete Personal Data;

3. Request deletion, destruction or anonymisation of Personal Data in certain circumstances;

4. Object to certain processing activities;

5. Request restriction of processing in certain circumstances;

6. Request transfer of your Personal Data where permitted by law;

7. Withdraw consent where processing is based on consent; and

8. Lodge a complaint with the relevant regulator.

The exercise of these rights may be subject to legal limitations and exceptions.

Before responding to a request, we may ask you to provide information reasonably necessary to verify your identity and confirm that the request relates to your Personal Data.

We will respond to your request within the period required by applicable law. If we are unable to fulfil your request, in whole or in part, we will explain the applicable reason to the extent required by law.
